DMCA & Takedown Policy

1. Our Commitment

MFK Group Inc. ("MFKVault") respects the intellectual property rights of others and expects our users to do the same. We respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and similar laws in other jurisdictions.

4. Counter-Notification

If you believe your content was removed by mistake or misidentification, you may file a counter-notification containing:

• Your physical or electronic signature
• Identification of the material that was removed and its former location
• A statement under penalty of perjury that you have a good faith belief the material was removed by mistake
• Your name, address, phone number, and email
• Consent to the jurisdiction of the Federal Court for the district where you reside (or Ontario, Canada, if outside Canada/US)
• Statement that you will accept service of process from the person who filed the original notice

5. Our Response Process

Upon receiving a valid DMCA notice:

• Within 24-48 hours: We review the notice for completeness
• If valid: We remove or disable access to the identified content
• Notification: We notify the content uploader of the takedown
• Counter-notice period: The uploader has 10-14 business days to file a counter-notice
• If counter-notice filed: We forward it to the complainant, who has 14 days to seek legal action
• Restoration: If no legal action is filed, content may be restored

6. Repeat Infringer Policy

In accordance with the DMCA, we maintain a policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

• First offense: Content removed, warning issued
• Second offense: Content removed, account suspended for 30 days
• Third offense: Permanent account termination

We may deviate from this policy in egregious cases or when circumstances warrant.

• Proof of your ownership or authorization

8. Good Faith Requirement

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.
